Iraq: Final election results referred to Federal Court for ratification

Baghdad, Iraq – The electoral process in Iraq is nearing its official end, as the Independent High Electoral Commission has referred the final results of last month’s parliamentary elections to the Federal Court.

This is a prelude to its ratification. This step is the final stage before the first session of the new parliament.

The spokesperson for the commission, Jumana Ghali, announced in a statement on Monday that “the commission sent today

All final election results are submitted to the Federal Court for ratification.

The transition to the ratification process represents the final stage in the electoral cycle.

According to the constitutional procedures regulating the transfer of power after the announcement of the results.

Article 93/Seventh of the Constitution and the Commission Law stipulate that the Federal Court is the competent authority to ratify the results.

Date of Parliament convening and government formation

Once the Federal Court has ratified the results, the commission will notify the President of the Republic.

Which requires calling for the convening of the new House of Representatives within 15 days.

After the first session is held, the oldest member takes over its management to elect the president and his two deputies, followed by the election of the president of the republic within 30 days.

According to Article 76 of the Constitution, the President of the Republic tasks the candidate of the largest bloc with forming the government within 15 days.

The designated prime minister is given another 30 days to present his cabinet lineup to gain a vote of confidence.

Although these constitutional deadlines may reach about four months from the date of announcing the results, the texts allow for their practical reduction.

This makes the timeframe for forming a government dependent on the extent of understandings and political complexities between the blocs.

Which often exceeds the specified constitutional limits, according to past experiences.
